French court: Poker is a game of skill

Posted on | August 6, 2011 | No Comments

Tribunal d’Instance de Toulouse, recently, in a case concerning gaming ruled that poker is a game of skill, at least in the format that has now been up for consideration.

Tribunal d’instance is to compare with Swedish district court, that a court of first instance and appeal can be appealed to higher courts, which means that the last word is probably still far from being said in this matter.

The case concerns the French poker player Jean-Pierre Gleize accused of having engaged in illegal gambling. Gleize has devoted himself to home games with his friends, but the prosecutor believes that there has been a question of a closed group and have therefore chosen to prosecute. If convicted, he could face both fines and prison.

The defense contends that poker is a game of skill and therefore not subject to the French gambling laws. Several expert witnesses have been heard in court, including a professor of mathematics, a poker pro and top-ranked chess and bridge player.

After an overall assessment, the Court has now ruled in favor of the defense – the Gleize and his friends have been involved in does not fall under gambling law because it involved a game of skill. Since it is a skill game, it could be counted as income and be taxable.

The prosecutor announced after the sentence was handed down that an appeal will be made. This means that the matter be taken before a court of appeal.

If higher courts would agree with the first instance assessment, this could mean that the poker sites do not need a gaming license to operate in France, but the players have to pay taxes.

More poker rooms closed

Posted on | May 24, 2011 | No Comments

Another batch of poker rooms have been closed down by the US authorities, amongst them Dolyesroom.com that we mentioned the other day. Guess Dolye had a hunch since he parted with the site just a short while ago.

The indictments allege that the defendants own and manage illegal offshore gambling businesses, stating that internet gambling operators rely upon the U.S. banking system and payment processors to facilitate the movement of funds. In addition, 11 bank accounts — located in the United States, Guam, Panama, Malta, Portugal, and the Netherlands — were seized on Monday.

A few of the sites now closed:

  • Bookmaker.com
  • Truepoker.com
  • Betmaker.com
  • Betgrandesports.com
  • Doylesroom.com

There are large changes going on in the US online poker market. This will once again mean a shift in the rankings which is good news for a number of smaller poker sites. Bad news for the players that were members on the now closed sites tho.

This probably means the end of Yatahay Network and the end of some other sites affiliated with them.
